Schotte & Anor v Town of Victoria Park

Algeri Planning & Appeals recently achieved approval for a ‘short-term’ accommodation use in an existing house in the Town of Victoria Park. The owners of the property had previously let out their property on a short-term basis to business professionals and now required formal planning appeal from the Town to continue this operation. Difficulties arise when the Town took the view that only traditional residential uses could be approved in this location.

Algeri Planning & Appeals successfully argued on behalf of the landowners that the management qualifications of the landowners and the changing dynamic of residential areas meant the proposal was capable of approval.
